Terms & Conditions
General Terms and Conditions
§ 1 Scope, provider
These General Terms and Conditions apply to all orders placed through the online shop american-parts.eu.
The provider and contracting party is:
American Parts s.c.
ul. Szosa Gdańska 46
86-031 Osielsko
Poland
Email: shop@american-parts.eu
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. By clicking the order button you place a binding order for the goods in your cart.
Receipt of your order is confirmed by email immediately after submission. This confirmation of receipt does not yet constitute acceptance of the contractual offer. The purchase contract is concluded as soon as we accept the order through a separate order confirmation or ship the goods.
§ 3 Prices
All prices are final prices in euros and include statutory VAT. Any additional shipping costs are shown separately during the ordering process.
§ 4 Shipping and delivery
We deliver to all countries of the European Union. Shipping outside the EU is currently not available.
- Germany: free shipping, regardless of order value
- Other EU countries: shipping costs depend on the size and weight of the parts and are shown in the cart before the order is completed.
GLS and DHL are available as carriers; both options cost the same. We ship on business days. Further details can be found on the Shipping & Delivery page.
§ 5 Payment
The following payment methods are available:
- Prepayment by bank transfer – the invoice amount is due for payment within 7 days of conclusion of the contract
- Cash on delivery – the carrier charges an additional cash-on-delivery fee for this
- Credit card, Apple Pay, Google Pay, PayPal and Klarna – processed through our payment provider Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland
§ 6 Retention of title
The delivered goods remain our property until payment has been made in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Please see our Right of Withdrawal page for details.
§ 8 Warranty
The statutory provisions on liability for defects apply.
§ 9 Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
